Many of you were gracious enough to help MotoAmerica racer Rocco Landers, age 22, when he was sued by Rivian engineer Greg Dachner following an accident on a closed-course Supermoto track at Adams Motorsports Park in Riverside, California.
During the incident, Rocco was involved in an on-track collision with another rider, which resulted in injuries to Mr. Dachner.
Mr. Dachner had signed a waiver prior to entering the track acknowledging the risks of the activity. Despite the waiver, a lawsuit alleging gross negligence was filed.
After experts were designated and as the matter approached trial, the parties reached a settlement and a notice of settlement was filed with the court. A dispute has since arisen regarding that settlement. A court hearing is scheduled in the coming weeks to determine whether the settlement will be enforced or the case will return to the trial calendar.
In the meantime, Mr. Landers still needs assistance to help cover the expert fees incurred during this process. I am continuing to donate my legal services to Rocco and to the broader cause of defending riders against lawsuits that refuse to account for personal responsibility on the track.
